Further leave to remain?

Post by cherize » Wed Apr 24, 2013 8:59 am

Hi people, hope someone could help on my query.
My friend was on Tier 4 visa, his current leave expired last February 2013. Due to problems he encountered on his college, like losing their license as sponsor he decided to find another college that will accept him but unfortunately no one accepted him as his college did not manage to provide a letter of progress. He went to see a solicitor as his visa is about to expire that time, and option that the solicitor gave him is to apply for a further leave to remain.? He said from the letter that the solicitor made, is he was asking HO to grant a further extension of stay for the applicant . What I don't understand is, he doesn't have a college . So is there any type of application like this? You are allowed to stay further due to reasons that it was not your fault that the college closed? And any chance that a student will be granted on this type of application ? We're there some applicants out there who applied same type of application like this? Can you please share your stories please.
Thanks!

He can make an application but (for the lack of further information or hearsay from you) there seems to be no basis on which such an application might be approved. As such, now it's just a matter of waiting for the refusal and a letter indicating where he may collect his passport on presentation of a valid travel ticket. I trust the solicitor informed him of this and that the money he was paying him, for what amounts to a waste of time, was very much appreciated.

Or perhaps this was merely an exercise in buying a bit of time to wrap up his affairs in the UK without the fear of overstaying? Who knows; certainly not you as you are not the subject?

Much appreciated for the piece of information.
I am just trying to help my friend, as I am not too sure whether he was given the proper type of application from his solicitor. As much as as I know, my friend was on this college who lost their license from the time he was about to renew his extension of stay under Tier 4. He tried to look for another college or sponsor but unfortunately none of the colleges he went to accepted him as he couldn't provide them a letter of progress from his previous college. He tried his best to get a letter of progress , but the college that time lost their license and administration is in a mess as the director of the school left. So he went to see a solicitor and seek help and this was the type of application being suggested to him. The solicitor made a cover letter telling all the details, what happened and it affected the applicant emotionally, so if HO could further grant him an extension of stay. Are there any chance that he will be granted? Is he allowed to work as well? If in case HO will refuse him, any chance he could apply to other category ?
If he will be granted, is he allowed to work full time?

Based on what you have said, and that you are not the actual subject of the discussion with more or better information, I can't really add anything to what I have already stated.

He could have switched out of Tier 4 into another category if he is eligible for another category, but it seems he has not applied to switch into anything. It's too late for switching now.
