You cannot make a fresh application while your appeal is pending. You can always apply for tier 4 after you have received the appeal outcome (provided you have not availed any further appeal rights, if any) and of course, if you fulfill tier 4 requirement. You can do so upto 28 days from when your your appeal rights exhausted.rajesh1984 wrote:i applied for ent tier1 visa which is refused and i am on appeal now

You can withdraw your appeal but I am not sure in how many days you will get the confirmation from the tribunal. (a letter or any documents that you may need to reapply).
