If a student has been here 10yrs now, with three dependents can that student apply for ILR.

No, if the dependents have been here for 10 years they will have to apply in their own right. So application fees X4.

The student(main applicant) applies first. The the dependants later apply to settle with the main applicant.

OR

They apply sepparately

The main applicant applies in their own right under the 10 year rule, the others need to apply separately to justify ILR.

As the OP has mentioned dependents l presume children are involved, so they could be registered as British once a main applicant gets ILR.

thanks, but i have read other post on here, where it says the time spent as student does not count towards ILR. this is really confusing.

Time as a student only applies under the legal 10 year stay rule. But beware this will/may be changed soon.

So what you are saying is my dad can apply for ILR, Nov 2009 will make it 10yrs in UK, but he was student then became a dependent on my mom.

Mom(student) will also be 10yrs in Feb 2010 and I will be 10yrs in July 2011.

Can we apply? I dont want to be refused.

1) Dad can apply from 28 days to the 10 years but must take the test and passed it.

2) Mum can apply in february or apply for settlement if Dad was successful.

3) You can do the same as (2) but i am not sure of your age which i think is a factor here.
