Dependent has been refused for additional document! ADVICE!!

Dear All,

As I am single parent and i applied for Tier-4 along with my one kid who is with me always.

but i got visa and my dependent had been refused as she didn't meet the requirement of Paragraph 319H(f).


i only submitted my divorce paper and only a paper from her Father's permission letter(in white paper). but not from court custody.

so is that I need a legal evidence from the court for prove that I am solely responsible for my dependent? or more things to do?

please advice what exactly documents I need to submit with the :? :(

319H. Requirements for entry clearance or leave to remain wrote:(f) Both of the applicant's parents must either be lawfully present in the UK, or being granted entry clearance or leave to remain at the same time as the applicant, unless:
  • (i) The Relevant Points Based System Migrantis the applicant's sole surviving parent, or
    (ii) The Relevant Points Based System Migrant parent has and has had sole responsibility for the applicant's upbringing, or
    (iii) there are serious or compelling family or other considerations which would make it desirable not to refuse the application and suitable arrangements have been made in the UK for the applicant's care.
Since you have filed for divorce, you'll need to prove sole responsibility of the child if you wish the child to live with you in the UK as your dependant.

Thanks a lot for the link.

I understood that I need to show the evidence that she was in my responsibility.

Can you suggest me how i can show the evidences actually which will be accepted for UKBA?

1. She was residing with me in a home, that is mentioned in both of our passport present address. (What more evidence can be gathered? )

2. I can show her school application forms I used to appeal and class teacher's signatures are there. ( i can show that)
3. I can show one or two doctor's written letter along with some prescription where i was with my daughter.
4. I can show my visa copy while I visited india 3 or 4 times where my daughter was attached in that passport.
5. I will show the sole custody from court.

please advice what or how efficiently i can prove that I am her solely responsible.

A court order granting you sole responsibility of the child.
