Visa rejected because of unconvincing reason

Post by mt3g » Tue Sep 27, 2011 3:32 pm

I completed my Bsc in economics from queen mary University of London june 2010. Now I wanted to do a HNC diploma in poultry production from scottish agriculture collage but my visa was rejected. The reason for refusal given was that this diploma had nothing to do with my previous degree and its at lower level of study. (I wanted to do this diploma because I have a family poultry farming business in Pakistan).

I am looking for some advice on weather I should appeal the decision or is there some law that says you cannot do a course on lower level than your previous one?

I was given 10 points for maintenance but 0 for CAS. The most wierd thing is this that my cosine who had also done a bsc form university of hull before applying for same diploma as mine has gotten his visa.

Any advice on the matter would be appreciated

See paragraph 63 of the Tier 4 Policy Guidance

If a Tier 4 (General) student has a CAS that was assigned on or after 4 July 2011, and he/63. she has previously had permission to stay as a Tier 4 (General) Student (or under the student rules that were in force before 31 March 2009), a Tier 4 Sponsor can only give the him/her a CAS for a new course if that new course represents academic progress from his/her previous study (for example the student will be studying for a new qualification at a higher academic level – for instance moving from a course at NQF 6 to one at NQF 7 -, or study at the same academic level that complements or enhances previous study at the same level). The only exception to this is where a Tier 4 (General) student is:
• re-sitting examinations or repeating modules, or
• making a first application to move to a new institution to complete a course commenced elsewhere

Did your new tier 4 sponsor include a declaration on your CAS that your course represents academic progress?
