Parents on ILR child yet to be registered as BC

Post by mkn » Tue Jul 24, 2012 4:57 pm

hi,

I thought i would get my daughter register as BC (through MN1) but I have to travel to india urgently. I read on the forum that registration can be done in india too, so

- Any idea how much time it take to get it done from india( BC reg+ passport)
- will there be immigration issue in UK or india since my daughter's Tier1 dependent leave would expire by the time we travel

Thank in advance.

Is it only you who is travelling or your daughter as well?

Since last week, all applications for naturalisation/registration are handled by the HO in the UK although the applicant can be abroad. UK passport applications from within the UK are much faster (2-3 weeks) compared to India (3 months).

There is no requirement to have a valid visa when a UK born child applies for registration.

Thanks Jumbo for the reply.

We all are travelling. Though i have booked an NCS appointment for my daughter registration for BC tomorrow but thought would not go for the appointment and apply for MN1 from india but problem is her visa expires on 31 July 2012.

Code: Select all

As you mention above can I then get my daughter register BC and then travel on expired Tier 1 Visa????

Go to NCS tomorrow. There is no point applying from India as it would mean sending the original documents to the UK.

When is daughter planned to come back? She will either need a settlement visa (based on your ILR) or a British passport to travel back. She should have no issue leaving the UK.

My daughter would be back in Dec/Jan, so I feel I would take your advise and go for NCS tomorrow and once the registration is done apply for BC passport from india(hope by Dec/Jan she should get the passport).

BC Registration I suppose would take 1-2 months??

Only worry i have is that as she would be travelling on expired visa, will there be an issue in immigration in india, I think UK should be fine , please advise..

I'm not familiar with Indian immigration. But I don't see why they would care about the status of a visa from another country.
