CHILD REGISTRATION.

I am on dependent visa and my husband currently holds a tier 1 visa. I have been in uk for 5 years now however, cannot apply for ilr as my husband was on student visa before. Me and my husband are separated now and i am going out with my boyfriend who holds Indefinite leave to remain. I am pregnant and my bf is the biological father of the baby. Once my baby is born can i register the baby as a british citizen as his father holds ILR.
If yes?? Can i apply as a carer for my child and stay in this country incase if my husbands cancels my visa. I Cannot apply as a partner as my bf is currently married.
I just have a few questions i need them to be answered.
Will my baby be british citizen?
How soon can i apply for derivative card?

Yes, the child would be British if born in the UK (no registration required), by virtue of section 1(1)(a) BNA 1981. The Father should be on the Birth Certificate. You may apply for FLR(FP) under exception 1 if:

UKVI wrote:EX.1. – (a) (i) the applicant has a genuine & subsisting relationship with a child who:
(aa) is under the age of 18 years or was under the age of 18 years
when the applicant was first granted leave on the basis that this paragraph applied;
(bb) is in the UK;
(cc) is a British citizen or has lived continuously in the UK for at least
the 7 years immediately preceding the date of application; and
(ii) it would not be reasonable to expect the child to leave the UK; or

(b) the applicant has a genuine and subsisting relationship with a partner
who is in the UK and is a British citizen, settled in the UK, or in the UK with
refugee leave or humanitarian protection; and there are insurmountable
obstacles to family life continuing outside the UK.

thanks Amber..

just want to clarify my child will be a british citizen even if i dont hold ILR and me and my partner are married to different people. we can still be named as parents on my babys birth certificate.

what documents are required for birth registration?
