90 days Absence rule

hi Gurus,

I have one question regarding 90 days absences in last 12 months, is it a sliding window e.g if some one stay outside UK for 120 days instead of 90 , can he apply after 13 months instead of 12 months for BC ?

If you have been absent for more than 100 days in the final 12 months you must apply for discretion.
