Dependent of ILR

Hello,

I got my ILR visa last year in Feb. My wife is on the dependent visa. I will eligibile for naturalisation in Feb next year. I wanted to know how does it affect my wife's visa since I no longer would have an ILR and she would not be eligible to apply for naturalisation becuase of the 3 year rule.

I know you were granted ILR under PBS. However, tell us about the immigration history of your wife. For example, when did she apply to become your dependant, etc.?

My wife got her dependent visa in October last year. She has been in UK for 6 years now.

Here'w what I did:
I got ILR in Oct 2013 PBS based and my wife got eligible on two-year dependant basis in March 2014 and I applied for her ILR in Sept 2014 on SET (O) form as PBS dependent basis. I went for PEO (same day service) and got her approval the same day. She had PBS dependant visa valid till Oct 2016.
After that I applied for Naturalisation of my daughter's (born outside UK) and myself on Oct 2014, we both got approved and wife is still on ILR. She will be eligible in March 2015 for Naturalisation on basis of spouse.

Hello Thanks for the response.

The thing is I am planning to apply for my naturalisation in next Feb. My wife won't have her ILR by then. She will still be on PBS dependent. Since I will not have my ILR (probably after naturalisation is approved), how is it going to affect my wife's immigration status.

No affect. She may extend as a PBS dependant, until she qualifies for ILR.
