Hello,

My situation:

My son was born in October 2014 and I was still on Tier 1 visa. My wife and son travelled to India in Nov 2014 and I got my ILR in Dec 2014. Since my son was not eligible for BC when he was born, I had to apply for Indian passport for the baby so that they could travel.

In 2015, I applied for 'family of dependent' visa for my wife and son and they travelled back to the UK.

Now, I need to apply for the British Citizenship for my son and am not entirely sure as to what I should do.

Since he was born here in the UK and now that I have my ILR, can I simply register him as BC. And if yes, how does this tie in with the fact that he has an Indian passport as well. Do I have to surrender the Indian passport later.

Or, do I have to go through the naturalisation for my son as well, which doesnt make sense as he was born here.

Please advise and thanks for your help.

After child registers, child will be British. British citizens cannot naturalise.

I have a quick question though. what would happen with the Indian passport that the baby holds. Do I need to surrender it to the Indian High Commission.

Do I have to do that once we receive the British passport for the baby, since Indian citizens are only allowed to have single nationality?

Yes.

No travel on Indian passport after 90 days of date of registration certificate and surrender of Indian passport can take place at any time within three years, but before any future travel to India.
