Dear Sir,

I would be grateful if you kindly help me out in a situation.

I got my British citizenship/passport on march 2017, my daughter (5 years) is on dependent visa she was born in Pakistan. Can I apply for her British passport or do i have to do naturalistion first as my status has been changed? Or under what route she will become British national? my wife is also on dependant visa on 5 years rules she spent about 3 years in uk same my daughter.

What application or form should I apply?

I will highly appreciate your time and cooperation.

They expect her to follow the same path as her mother to ILR, prior to registering for British citizenship under Section 3(1).

When I read chapter 9 . I just read it's say one parent should by British and other settle and when I read. Chapter 9, and section
9.17.9

When I read through other parent status, settle ..... or while not settle ....

I think I may qualify for this.

Would you please comment on this.

If your wife is not settled, how exactly do you think your child who was born in Pakistan will qualify?

is it not on HO discretion wether they might accept ?

Citizenship and immigration status of the parents

9.17.9 : We should normally expect that:

 at least one parent is a British citizen

or

 one of the parents has applied to be registered or naturalised as a British citizen and the application is going to be granted (if the parent’s application is to be refused, we should normally refuse the minor’s application as well);
and

 the other parent is either settled in the United Kingdom (see Annex F to Chapter 6); or

 whilst not settled, is unlikely in the short or medium term to be returnable to his or her country of origin (eg s/he has been granted Discretionary Leave), and there is otherwise no reason to think that the child’s future does not lie in the United Kingdom.

The last condition contains an "and". It is unsatisfiable as your wife is returnable to her own country.

What do you think vinay? My wife will remain in U.K. And I will apply her extension visa in next year june2018. Will HO use discretion and allow my daughter to give naturalisation
Or what are the chances in percentage wise ?

If your wife is NOT settled (i.e. has ILR) then almost zero chance to register your child born abroad. There is no shortcut, suggest accept this fact and plan accordingly.

Just to confirm? Had I missed the opertunity when I applied for my BC I apply for my daughter (same time) as well under family BC and then might be HO use its discretion to give B Nationality to my daughter?
