New born baby on Tier 2 visa expired

Post by siva_b » Wed May 10, 2017 11:19 pm

Hi friends,
I have a small Questions would like clarify with experts.

Recently I moved to new company and got new Tier 2 visa through new company few weeks back(through same day service) as I will be eligible for ILR in the next month(June 2017).

Child: Boned in UK last year applied Tier 2 dependant visa last year and is going to expire 15th of May 2017.
We have not applied for Tier 2 dependant visa yet under my new tier 2 visa.
So here my Question is Can we apply directly Citizenship for my Baby after I get ILR in first week of June 2017? He needs to be without visa for 20 days before applying for Citizenship, is that Ok?

Please let me know

Thanks for your valuable suggestion in advance

Hi Siva,

Please keep us update because I am also in same situation.

I got my T-2 in Feb-14 valid till Oct-17. I have 3 kids, all born here in UK and have BRP valid till same date.
I am in the process of changing my employer and after that planning to visit my home country before the expiry of their (kids and wife) leave.

After return, my wife will extend her dependent visa but we are thinking not to apply for kids.
As we will get ILR in Feb-2019 then we can apply for them.
So keen to know outcome of your application to understand if there is any risk involved?

Good luck with your application...

A risk is being an overstayer with associated problems, until granted British citizenship. For example, they may also not use the NHS for free, etc.

Hi

There should be no problem as child born here , u dont need to worry he wont be overstayer and he will be eligible for registration as British. And he can use all NHS etc free

This is my personal experience

My son was overstrayer, when i got my ilr i have applied mn1 for him and now he has British passport.

Thanks

Can you please start your own topic with your circumstances and questions instead of digging up and tagging onto a topic that is more than a year old.
