Proof of NI contributions + "activity condition"

Post by wonderer98 » Fri Nov 16, 2018 2:06 pm

How long do I have to provide evidence of NI contributions for?

The Guide (page 7) states:
“1.45 - 1.50 In some cases, if you have ever been in breach of immigration law, you may be asked to provide details of all your National Insurance contributions made for your current and previous employment during the past 10 years”
https://assets.publishing.service.gov.u ... _2018_.pdf

The Form (last page) states:
“SECTION 10 Evidence of National Insurance contributions covering the relevant period”
https://assets.publishing.service.gov.u ... -09-18.pdf

Borders, Citizenship and Immigration Act 2009 states
“Section 41(1) inserts a new paragraph 4B into Schedule 1 to the BNA 1981. This sets out what the qualifying period will be for naturalisation as a British citizen. The qualifying period is different depending on whether the applicant is applying under section 6(1) or (2) of the BNA 1981. For applicants applying under section 6(1) of the BNA 1981, the default qualifying period is eight years. For applicants applying under section 6(2) of the BNA 1981, the default qualifying period is five years. These periods can be reduced to six years or three years respectively if the applicant meets the activity condition. The activity condition is further defined in paragraph 4B(5).”

“Activity condition” is vaguely defined.
The applicant meets the activity condition if the Secretary of State is satisfied that the applicant—
(a)has participated otherwise than for payment in prescribed activities; or
(b)is to be treated as having so participated.]

As a person not married to a British Citizen do I have to provide details of NI contributions for the whole 10 years I was here or for the past 6 years or 8 years if I do not meet “activity condition”?
How can I meet “activity condition” if it helps me reduce the burden of proof to 6 years?
I am asking as I am having a very hard time to find evidence beyond 6 years.

For any gaps give approximate details and explain in a separate note.
This is just my opinion as a member of this forum and does not constitute immigration advice.

I have a question about the interpretation of this guide.
https://assets.publishing.service.gov.u ... s-v5.0.pdf
"If an EEA national has previously had a right of residence in the UK as a jobseeker,
that previous period of residence should be deducted from the relevant period,
unless it was prior to a continuous absence from the UK for more than 12 months. "

Here is my timeline:
1. Student
2. 2 weeks unemployed
3. Employed for 2 months
4. 2 months unemployed
5. Employed for 2 months
6. 5 months unemployed
7. Employed for 6 months
8. 89 days unemployed
9. Employed for 5 years and 10 months.

During my 89 days of unemployed, I can produce email proving I was looking for work (because I was hired in that position)

Does the document in the link state that my period of 91 days finished after second employment?
Or can I write down that during the first 3 unemployed periods I was self-sufficient?
Would I have to prove that during my naturalization application?
