Hi,

I have some questions,


1.....After Tier 2 partner gets ILR, can they apply for BC straight away, Main applicant's BC necessary or main applicant having ILR would work too ?


2.....Let say main applicant received BC, they haven't attended BC cermony yet, can there PBS partner apply for BC straight away after ILR in this scenario ?


3....PBS partner must be in UK on the day they apply for BC, do they need to be in UK exactly 3 years ago or 5 years ago ? answer to this question would be different if main applicant received ILR or BC

1. The spouse must be British for the other spouse to apply once ilr is granted. They must also meet all the requirements for citizenship based on 3 years residence.

2. You are only British once you have attended your ceremony.

3. Three years. To apply for citizenship based on spouse if British person it is a section 6(2) of the nationality act application based on 3 years. If the spouse only holds ILR when the other spouse applies for ilr, then the mandatory 12 month wait stands until the other spouse becomes British at their ceremony.
