Registration as British Citizen

Post by Deejo89 » Mon Jul 22, 2019 8:01 pm

Hi,

I got my ILR by Jan'2014 and got UK naturalisation in the year 2015. Now, I hold a British Passport. My wife and kid are currently in UK Spouse Visa (FLR-M). When my kid was born, I was holding an ILR. My kid was born in India.

My question is, do I have to apply for an ILR for my kid after they complete 5 years and then go for UK naturalisation or is there an option for them to register themselves as British Citizen because at the time of their birth, I was holding ILR.

As the child was born abroad before you naturalised, the child will follow the same immigration path as the less-privileged parent, will need to apply for ILR at the same time as the less-privileged parent and can be registered as a British citizen when at least one parent has British citizenship and the other parent has ILR.

Had the child been born in the UK while you had ILR, the child would have been born a British citizen and you could have applied directly for a British passport for them.
