Does overstay affects naturalization?

Post by Marian2012 » Sat Mar 31, 2012 5:52 pm

Hello I would like someone help with this doubt

I applied for SET M and in case I get it I could apply in 3 months for naturalization as spouse ,my application for SET M is 1 month and a half out of time my question is :

in case I get ILR this 1 month and a half overstaying would be a problem to apply for naturalization?

Many thanks in advance ,

Marian

Are you sure you are an overstayer? If you applied for your ILR before the expiry date of your previous visa, then you have so-called Section 3C protection. That is, the old visa is "treated as continuing" even though the stated expiry date might have passed.

Such Section 3C Protection continues until the new visa is granted, or if it is refused, until the time for appealing against the rejection has ended, and extended further if an appeal is indeed lodged before the deadline.
