Baby born before parents granted ILR.

Hi,

My baby was born in April this year and my husband and I are due to apply for ILR in July. As I figured out from posts in this forum that I can apply for baby's registration as a British citizen using MN1 once we get our ILR. Later I can apply for his British citizenship. In this case I dont need to apply for baby's ILR and also I dont need to have an Indian passport for the baby.

I called up UKBA to confirm this but they have a different view. They said that I definitely need to apply for baby's ILR and therefore need to get an Indian passport for the baby first. Later once he gets ILR then I can register him as a British citizen.

I am quite confused now and I was hoping if any of the member who has been in a similar situation can share there experience.

Provided the Baby in Born in the UK.
in which case once either of the parents get ILR the baby in entitle to register as British Citizen. The immigration status of the baby is irrelevant (does not need to have ILR).

If you do not intend to travel before you getting ILR then you would not need passport. if you want to travel then baby should get the passport and appropriate dependent UK visa before leaving UK.

Registration is applying for British citizenship. There is only one application. Later, he can apply for a British passport if you wish.

The advice given was wrong. Many forum members have skipped ILR for their UK born children.

Call HO and ask this question - "Once I get ILR and apply for registration as BC for my UK born child under section 1(3), does his immigration status matter? Would it matter if he has ILR or not?".

The answer is "No".

we submitted our application in the july 2012. baby born on sep 2012.
we received bio metric card with issue date mar'13. but the expiry date is july'2022. i get confused whether can i take british passport for my son or not.

relevant date is the date you was granted ILR.
