Hi Guys

I moved to uk Oct 2007 as a student and been studying at uni till last year, got married to a polish citizen
who's been living and working in UK for the last 9 years & I got EEA, EU Family member residence document
on Feb 2012 valid until Feb 2017.

I understand applicant should have been present in the UK five years before the date of his application;

the question is when I can apply for British Citizenship?

Many Thanks

6 years after your marriage.

The reason is that in addition to the 5 years residence there is a requirement to hold ILR/PR for at least 1 year. You are likely to achieve PR under the EEA regulations 5 years after your marriage. I presume you will not be able to apply for ILR before that.

Thank you so much for your quick response.so I assume I cannot combine
my stay, holding student visa with the recent EEA to sum up to 5 years.

What if my wife apply for British Passport, then would I be able to apply for ILR or directly for British Passport?

Many Thanks

You can't combine the two categories in order to qualify for ILR/PR (which is what you are missing).

Not really. If you wife is British. You can apply for naturalisation once you obtain PR/ILR which will still take 5 years (so you save one year if your spouse is BC).
