Hi,

I have read various posts and documentations like Guide An and Booklet AN and application form due to be filled.

I'm convinced that I and my wife both can apply for British Citizenship. However, I want a confirmation on the eligibility to apply from some gurus/experts here which would give me a peace of mind to proceed ahead.

Main Application (myself)

Work Permit >> Extended work permit >> HSMP >> Tier1 >> ILR issued on --> 29th Sept 2011

Main Applicant Absences:

4th Aug 2007 - 27 Aug 2007 - 24 days (India Trip)
16th Feb 2008 - 16 mar 2008 - 29 days (India Trip)
30th Nov 2007 - 2 Dec 2007 - 3 days (Holidays to Europe)
24th Apr 2010 - 9th May 2010 - 16 days (India Trip)
8th July 2010 - 18th July 2010 - 10 days (India Trip)
3rd Oct 2010 - 9th Oct 2010 - 7 days (India Trip)

Total absence : 86 days

Dependent Application:
----------------------------

Work Permit dependent Visa >> Tier1 Dependent Visa >> ILR Issue date : 29th Sept 2011

Dependent Absences:
--------------------------

8th March 2010 - 18 July 2010 - 133 days

I'm planning to apply together on 3rd of December 2012, exactly 5 years which is 4th December 2007 I was in UK and my wife exactly 3 years on 4th December
2009 she was in UK.

Below are the documents that I have gathered to submit:
1) 2 Passports and British Driving license.
2) Life in the UK Test certificate.
3) Marriage certificate from India.
4) 2 Application forms.

Below are the questions:

1) Could some of the GURUS/experts please confirm if my wife and myself can apply together and are eligible for British citizenship?

2) Do I need to show employer letter from my employers?

3) Is there anything that I'm missing that might jeopardize my application?

Two comments:

* Absences are calculated as full days (24 hrs) outside the UK so you don't count the day of departure and day of arrival so if you left the UK on 30th Nov 2007 and returned on 2nd December, that would be only 1 day.

* There is no concept of dependant in naturalisation. Each applicant needs to meet the requirements including the 5 years residence. Has your wife been living in the UK for 5 years?

If ur wife came to uk in 2009,she can't apply with you as she is not here for 5 years.
You should get BC and then as a spouse of BC she can apply on basis of completing 3 years required period here.

My Wife entry date into the UK was 16 May 2008. Hence, I was venturing on applying on the basis of 3 years in UK?

Many Thanks for your reply. I misunderstood the eligibility concept of naturalization for spouse. For my wife I will need to wait for next year, after May 2013. Because she came into UK on 16th May 2008.

Or follow the advice in Q2 in the FAQ. Apply now and once your application is approved and you attend the ceremony, you wife can apply as a spouse of a BC. The downside is paying two fees. If you apply together in May, you can enjoy from a joint fee (£400 cheaper).

Thank you all for the help.

One final question. Just to save approx £400, I was thinking to wait till May 2013 to apply both applications. My question is, are there any advantage/loss by me taking Naturalization in May and not now?

Doesn't really make a difference (maybe just a few more quid as the fee is normally increased in April) assuming of course you still meet the requirements (so no long absences until May or being charged in court).
