Dear All
My friend's son lives in UK for the last 15 years. Never left UK. He was born in Egypt and moved in with his mother to London when he was 1 year old. His mum applied for ILR but not success yet. He is missing all school trips and holidays. Basically stuck here. I told her that there is a way to apply for British Citizenship for him under special circumstances. Can somebody advice me if I am right. The boy knows English perfect, going to school and is well behaving. I will help her to fill up application for him but I need to know if he has any chance. We will be applying on MN1 form under discretion.
I will appreciate any comments
Monika

Probably yes, but logically thinking the kid does not know any other life and it will be extremely difficult for him to get the NIN and job once he get 18. They can not come back to Egypt and his travel history is zero. Anybody has any idea ? I want really to help him.

Well he doesn't need British citizenship in order to get NIN or a job. They need to legalise their stay. This has become more difficult now that the 14 year illegal stay route has been abolished but there are still some options to stay. Later they can apply for BC.

I was hoping he can apply on his own and his mum status will carry on. I am not sure it's illegal. Her father was here half of his life. She was traveling to UK quite offten in her childhood. She arrived here on a legal base. Is just last few years when she want to extend her stay. She is waiting few years now for Home Office decision. Changing solicitors and spending money. On spring his class has a trip to Paris and I was hoping to help him before. So do you think the form MN1 is not for him ? Thanks for all reply so far.

I suggest you check exactly what the child and the mother current immigration status is. It is difficult to advise without the full facts.

She arrived here on 6 months visa in 1998. Then she got married and had some visa on this base. However in the mean time her husband left her and after a time she lost her visa. Since 2001 she is changing solicitors ( most of them closed up) and the last one is trying to appeal against the decision. The Home Office told her in the last letter that her file is lost. Solicitor said that if they refuse her again then he will apply for ILR. Considering that she spent the last 15 years here, has small succesful business, paying Tax and NIC, bought her own flat plus did not visit Egypt or any other country within that period I am just thinking what is the best for her. But because her situation with Home Office is unclear I just need to find out if is possible for a child to apply for BC without parents. How does it work ? Thanks in advance
