Child born UK

Apologize for the double posting.. this has been posted in ILR section as well.

I have a son who is born in the UK and has got an Indian passport and a visa(Tier 1 general dependent) which expires in the same date as mine(03rd Mar 2013). I have booked an appointment with Croydon PEO for three of us(me, my partner & son). My case is straight forward and expect to get the ILR(fingers crossed). My confusion is do I need to include my son in ILR? or is he eligible for the BC if our ILR application is successful?

Of course on the cost perspective I will be better of if I can directly get him the passport. please help me to resolve this confusion.

Q3: I’m due to apply for ILR. Can I skip applying for ILR for my child?

If the child is UK born, then he can apply for registration as BC once one parent is granted ILR, irrespective of immigration status so ILR application can be skipped. However, the process of applying + passport application can take 3-6 months so if there are plans for the child to travel during that period, he will require a suitable visa to re-enter the UK. In that case, you should not skip the ILR.

For children born outside the UK, ILR is normally required.
