British citizenship through marriage to EU/British national

Hello people, I majorly need your advise here please. Got married married 5 years ago based on an EU law (Irish national) as my wife as a dual nationality, she is also british by birth. I want to apply to be British, as my EEA residence expires soon. On the application it says non EEA have automatic permanent residence right provided their spouse has evidence of exercising Treaty Rights for 5 years for the relevant EEA national. It asked for the evidence when applying for naturalisation as part of the requirements. I want to apply based on her British nationality not EU, is that ok?

The thing is my wife hasn't worked for nearly 2 years (although I have always worked) and we are expecting our third child in the summer. What do I do here because i may not have two years of her performing treaty right. I need help please?

you cant do it, you have to follow eu patch. To get naturalization as spouse of British citizen you will have to be on visa under UK immigration rules.also if she did't exercise treaty rights for 2 years looks like you have to get csi now for whole family and after 5 years claim that she was self sufficent.

Thanks for your reply. Is there anything else I could provide as she is currently pregnant and not fit to work to proof that she is exercising treaty right as I do work? I can't be denied on the basis that my EU/British spouse hasn't worked for a year can I? my What's csi?

if she is unemployed you can provide evidence that she was looking for work(if she was). If she is only sitting in doors and living of your income you should get private insurance ASAP. Otherwise your residence in the UK nay be unlawful. with private insurance she can claim that she is self-sufficent.
