Hi,

My wife is peruvian and has lived and worked in the UK since August 2007. My wife currently holds a 5 year UK residence permit in her peruvian passport stating that she is a family member of an EEA citizen. The permit expires in June this year.

I hold dual nationality: Irish / British.

Question: Given the imminent expiry of my wife's residence permit what are the next steps we need to take to get her a british passport?

Assuming you have been exercising treaty rights in the UK for 5 years (working for example), she can apply tomorrow for British citizenship. She just need to pass the Life in the UK test.

Thanks. I understand then that my wife can apply for naturalisation (british citzenship) now. Some further questions if I may....

1. I presume that the c£850 fee will still apply.....even though she is a family member of an EEA citizen exercising treaty rights (and that I am also british)?

2. How long between application and taking a test?

3. We need to travel to Spain in May. Can my wife still travel with me to spain on her peruvian passport at that time (with residence card which expires in June this year)?

1. Fee applies to everyone. Note that the fee increases slightly if applied after April 6th.
2. She needs to take the test before applying. Please note that format of the test changes on 25th March.
3. No problem to travel if you use NCS to apply for naturalisation. This will leave your wife with her passport.

It is required to support her application (5 P60s for example) together with both your Irish and British passports.
