Help - Naturalisation Application time clarification

Hi guy,

I am so confused of my application timeline of BC. Can someone help to reply my questions? Please.....

My background as below:

1. Married to a British Citizen since 2004 but most of time not live in UK until 2010.
2. Date to UK with spouse visa: Oct 20, 2010
3. ILR granted on May 16, 2013
4. Days outside UK from Oct 2010 - June 2013: less than 25 days

My questions are:

1. Am I qualified to apply for the Naturalisation if handed in the form on/after Oct 20, 2013?

2. If not, should I hand in the application until May 2014?

3. Do I need to take the required English course (e.g. ESOL) if application after Oct 28, 2013?

I am not sure the residential qualifying period, i.e. 3 years, to my circumstance.... as my spouse visa was expired on Jan 10, 2013 and the ILR was granted on May 16, 2013....So, the period from Jan 10 to May 16 would be counted as qualifying one or not...

Please kindly help.... Thank you in advance....

You may be able to apply on or after October 20th subject to you being physically present in the uk 3 years prior to the HO receiving your application and meeting the other requirements. After 28/10/12 if you have a degree taught in English you should not need to have any further language requirement but for the LIUK test certificate. If not then after 28/10/13 you will need to satisfy the further requirements but the LIUK test will suffice before this date.

Thank you for your quick reply.

Assuming that I fulfill all the requirement but the qualifying period and the English requirement, I do want to have your kind advice.

1. My lawyer told me to wait for a year (May 2014) to apply because I need to have ILR at least a minimum period of 12 months to do so...that is why I am so confused....I have been legally staying in UK for 3 years in Oct 2013....I think it should meet the said 3 yrs qualifying period.....

2. I have a degree taught in English in my home country and how to prove it for UKBA. However, if it was not taken as accredited, which course or test I should take before my application after Oct 28 2013. I passed LIUK test.

In fact, I intend to hand in the application before Oct 28 if I am qualified. It is because I don't want to take any tests or courses for UKBA's additional requirements....I think some of us will also have such circumstance....

As you are the spouse of a British Citizen you do not need to wait 12 months you just have to be settled (granted ilr in your case) and have been resident in the uk at least 3 years and meet the other requirements. If you apply on 20 October 2013 your LIUK will suffice the KOLL requirement.
