Eligibility Residential requirements query

Hi,
I would like to apply for neutralization for my wife along with myself. We will be applying thru Nationality Checking Service on 27th Aug 2013.

My wife has been away (out of UK) in the last 5 years. The total number of days is however less that 450 in last 5 years.

Based on the below data can you please advise if we can make the application on 27th Aug'13. She was not in UK in 28-Aug-2008 but was here before that.

Start Date in UK: 01-Dec-2007
ILR Date: 25-Aug-2012

Start Returned Days Reason

31-May-08 15-Aug-09 440 Child Birth Break
10-Feb-12 03-Mar-12 21 Holiday
31-Mar-13 19-Apr-13 18 Holiday

Philmx0a,

Nope. she should have been physically present 5 years before the day on which you are applying. In this case work backwards from 27th August 2013 and you will see that she has been out for most of the days in 2008 (the critical year). Her application will be ''Neutralized'' :-)

Hi All

Can please someone advice if me and my wife don't have our previous passport since 3 years ago, how can we demonstrated residential requirements ?? but is NOT doubt we haven't been more then 450 days in last 5 years . our new passport can only show stamp since 2010 ..

SECTION 3 Evidence of lawful residence during the 5 (or, if the applicant is married or in civil partnership to a British citizen, 3)
years before the date of the application: required for applications made on the basis of residence in the United Kingdom:
required for all applicants
• Your passports OR
• Letters from employers, educational establishments or other Government Departments indicating presence in UK
