HI,

Just wondering if there's a chance of getting British Citizenship with a caution (2002) and a conditional discharge (2011) on my rap sheet?

Thanks

Were the two offences the same?

Hi,

THe caution was for smoking pot in public and the discharge was for ''common assault''.

Was the discharge conditional, if so what was the prescribed period?

I was given a two-year conditional discharge.

3 years after the date of conviction, you should be ok to apply. Declaring both the caution and conviction.

Also wondering why The Nationality Policy Guidance and Casework Instruction Chapter 18 Good Character Requirement doesn't mention discharge or conditional discharge amongst the non-custodial sentences?

This guidance is a lot better than the previous one

While it is true that it does not specifically address Conditional discharges, this document which they brought out in October 2013 is much better than the ambiguous previous version. A lot of effort from people like Amber and a few others who pestered the home office to clarify various issues bore some fruit.

Having said this you can see the case worker guidance on Conditional discharges here..
