British Passport for a children born in the UK

I need some help please. I am a father of the two boys. The first was born in January 2011, the second boy was born in January 2014. I have been here legally and continuously since September 2006 and my partner since 2009. We are from Hungary which is part of the EU. Also I have “UK RESIDENCE DOCUMENTATION FOR A NATIONAL OF AN EEA STATE” document since 06/2008. I would like to get British passport for both of them. Do one of us (parents) need to have 5 year legal stay in the UK prior the birth of your children in order to get a British passport? If it is the case I have 7 month missing for application of the first boy but the second one can get it. It would be pretty weird if the older one could not get British passport while the younger one had it. Is it right?

Assuming you have been exercising treaty rights for 5 continous years (by employment for example), then you have obtained PR.

Children born in the UK to a parent who have PR status are British from birth and can apply directly for a passport.
Children born in the UK when the parent doesn't have PR can apply for a British citizenship once a parent holds PR. There is a fee for this application (£673).

Thank you for your help. In our case then we need two different kind of application. At the time of the birth of our first child none of us had 5 continous years. Therefore for this boy we cannot apply directly for passport, first we will have to apply british citizenship then when he has got the citizenship,we can apply for passport. For the younger one we can apply because one of us had 5 years continuous NI paid and worked here.. is that right?

Dear All,

Both my and my wife hold ILR and have not yet decided if we want to take a citizeship. We have two children and both of them have ILR because both were born before we took our ILR. We are expecting a third child now and birth is planned in UK. From what I understand the child will be eligible for British citizenship by birth. My question is

a) Is there an option for baby who is going to be born to take a Indian citizenship. If yes then what is the process.
b) Someone told me that even if the baby takes a Indian citizenship (passport in London) even then the UKBA will not allow a PR application since the child is born in UK for settled parents.
c) What is the normal processing time for British passport for baby born in UK
d) Is it true that OCI will be given to children with atleast one of the parents have OCI

We have a child born in the UK. We are eligible for ILR this June. We like to travel as soon as possible to our home country (Malaysia) when we get the ILR through PEO appointment. I understand that the child is eligible for a British passport as soon as we get ILR. But is it possible for him to apply for one when he leaves the UK (with a Malaysian passport) and return as a visitor later?

Hi all,

Do you think is there any reason I can't use the fast track passport service for my 4 month old baby? We are EU citizens, and been living and working in the UK since 2006. Today We went to the London passport office and they sent us away saying “The applicant is exercising treaty rights and therefore must apply by post”
Is it possible they were wrong? I called them before the appointment and booked it, explained the situation and all seemed to be ok. Maybe I just got unlucky with an incompetent agent. Is there any EU citizen who used the fast track service to get a passport for their baby?

We are Hungarians (EEA member) live in UK since August 2006.We expect our child beginning of October and we 'd like to get a British passport for her.
My question is, can we apply for British passport for my child?
What are the requirements in order to apply?
Would we need to get the form from Post Office?

If you need to register child first use form MN1.
