British citizenship for wife

Hello,

I have read much on the forum and I think the answer is yes but I would like it confirmed- as there is a lot of hassle and £900 at stake if I get it wrong!

My wife would like to apply for BC.
She has been in uk since November 2010, first as dependent of tier 1.
I got ILR in Apr 2011 and BC in Sep 2012.
In Sep 2013, she got ILR.

The question is: can she apply for british citizenship now or does she need to wait.

Only spouses of British citizens can apply as soon as they have ILR and meet the residence requirements. Everyone else must hold ILR for one full year before they can apply.

she can apply now as spouse of british citizen based on 3 years residence and meeting the standard requirements. make sure she was physically present in the uk exactly 3 years ago on the date the ukba receives her application, this criteria includes if she was on holiday for example., as this is an automatic refusal point on presence.

Yes she would have been here 3 years previously when we intend for home office to receive her application.
