You need to be free from immigration restrictions when applying. You're restricted if your visa has an expiry date. So, you need ILR/PR at the time of application. If applying for 5 years residency, you'll need to have been free from immigration restrictions (i.e. held ILR) for at least 12 months before the date of application.
