hi guys i need your help
i was caught driving with no insurance 2 years ago by police i was given a 6 point from driving licence and a court fine of 600 pound wich i paid - and did not attend the court -
will this going to affect my application for naturalisation as am planing to apply with my children in few days ?
please advice as soon as you can .

thanks for your reply , no i want to explain some thing , the reason that i was driving with no insurance is that i have changed my address and the insurer company send 2 letters wich i dindt recieve and they stoped the insurance , i was abroad the day i came i droved my car and when the police stoped me i was 100% sur that iam insured the the officer with my permission phoned the company and they told him that i didnt informed the company of my change address! then the officer stated in his statment that and and stated ( my openion : as far as i am concerned i was driving with insurance )
i have all that in writting ,
do you think sir , will the ukba officer sympathise with my case ?
i am having tomorrow an appointment with townhall to check my document to be sent to ukba , please advice .

I would wait, I doubt the NCS will deal with your case until 3 years has lapsed.

It's your responsibility to ensure you are legal to drive, I'm afraid you're guilty as charged and best to wait.

(Q8 - I have one non-custodial sentence but 3 years has not lapsed, will they still refuse me?

If you have a single (one) conviction (non-custodial) and it occurred within the first 2 years of the 3 (i.e. you have had no offences within the last 12 months), there are strong countervailing factors which suggest that you are of good character in all other regards and the decision to refuse would be disproportionate then it may be deemed an exceptional case and your application may be granted (exceptional grant under section 10(b) of Chapter 18, Annex D) despite 3 years not lapsing since the date of conviction. It may be wise to only try this where the non-custodial sentence was for a 'minor offence' and did not involve drugs or violence for example. See also, )

You may if it's your only conviction and you can show that due to your child's disability you need to be naturalised, you should also include a character reference letter from a professional.

Except that driving without insurance is not a minor offence.

It's subjective as to what amounts to minor. Moreover, it doesn't need to be minor necessarily. Given that the offence was dealt with by the magistrates and was non-violent and not drug related he may be ok.

yes that's the only one i have , no other conviction or FPN ,PCN

Then you can chance it and ask for an exceptional grant under section 10(b) of Chapter 18, Annex D. Don't complain if rejected though.

Write in the extra information box that you would like consideration for an exceptional grant due to child's disability and welfare of child isn't imperative you're British. Also a professional character reference letter included.

Yes talk about the conviction but don't deny it, learn from it.
