Residence requirement -Absense for 120 days

Hi
My wife was out of country for 120 days after our ILR. Would that be possible for her to apply still with 120 days absence?
Our ILR was granted in August 2013 and we intended to apply by completing 12 months period if my wife is eligible to apply. She went to India in August and returned in December.
Could any one confirm if any one had a situation as like me and got their citizenship? Also, would that be possible for us to wait for another 2 months of time and then calculate the last 12 months period by leaving the absence in September and October ? If I calculate the 12 months period from November then the absence will reduced to less than 90 days.

I was absent for 120 days in the final year and I applied for discretion. It took 8 weeks for HO to approve my application.

Hi,
Thanks for your reply, have you sumbitted any additional document to demonstrate links with the UK through presence of family, and established home and a substantial part of your estate ? I have referred the AN booklet and found that we need to establish the link in UK- details can be found on the below link..

This is was my statement on page 15:
"I wish to state that I have made the UK my home together with my family - my wife and 16 year old son who are both British citizens and live in the United Kingdom. With my family, I live in a rented house which is in my name. In addition, I have a large part of my estate in the United Kingdom. In the past few months, due to the nature of my work, I had to spend several weeks working abroad and therefore I am requesting for discretion to be applied with regard to the requirement to have not been absent from the country for more than 90 days in the final year."
The lady at NCS said that all I need is to enclose my sons birth certificate as he was born here. No additional documents necessary even though I had with me bills, tenancy agreement, my sons school report, etc..

Thanks for your reply mate, this is actually for my wife, she went to india for a vacation and stayed there for 120 days. Any idea how i can support her application with evidences ?

Her passport should be enough.

In order to prove absences you need to submit your passport.
