Hi there,

My wife and I came into the country in 24 Jan 2011. I am a British National and below is the history of my wife immigration.

First Arrival + 24 Jan 2011 on UK Spouse Visa ( Married to UK National)
Left UK on- 16 Nov 2011
returned to UK - 1 Oct 2012
ILR Granted- Mar 2013

Since Mar 2013 we have been continuously living in UK. However, from the period 17 Nov to 30 Sept 2012, 10 months we were mot in UK. Considering this period out of UK , My query is when should we apply for citizen to complete the 3 year UK residency requirement for nationality and also should we consider that Home Office has a discretion of waiving 270 days spent outside UK during the 3 year period.

thanks.

If your wife was absent for more than 270 days in the last 3 years that she has to apply for discretion.

Thanks for the reply. However, based on the dates provided what date should we send my wife application to home office.

As earlier informed, we came first into the country on jan 24 2011 and the 3 yr period completed on 24 jan 2013. Also my wife got her ILR in March 2014.

Thanks.
