Registering a child as British Citizen

Hi there,

I wonder if you could clarify something for me.

I'm a Italian citizen and my fiancée is Polish. Our daughter was born in UK in 2011.

My partner has been leaving in UK since 2006 and I since 2008. Recently (last May) I applied for my permanent resident card and got it.

But my partner and I had a resident card before, so is my daughter British citizen or do we need to apply for it as I'm now a permanent resident in UK?

How can I check if she is registered or not?

If we need to apply, could you please let me know if the following is correct?

- MN1 form is the CORRECT one and I should apply under 1.3 rule.

- Why the question 1.3 on that form asks for her indefinite leave to remain in UK? do I leave it blank?

- Section 2 is also confusing as my daughter is only 3 years, should I complete it?

- Section 5, do the referees must be both British, can they be my childminder (she is not British) and my work colleague (British)?

- Which ORIGINAL documents should I send?

What did your fiancée do since 2006? Did she exercise treaty rights (employment, study with a health insurance, self sufficient with health insurance). Did she complete full 5 years of residence before the birth? If the answers to both questions is yes, then your child is British. Otherwise, MN1 is the correct form.
Apply under 1.3, leave 1.3 blank. Fill in the first part of section 2. The references are fine.

Thanks for your response.

She's been studing (university) and working since she's got in UK - arrive in April 2006 - but, I'm not sure if the Polish citizen, back in 2006, had some restrictions to work in UK or not, would this restrictions (in case they existed) affect my daughter citizenship in any way?
Also, my daughter was born in January 2011 so, not a full 5 years from April 06 to January 11.

I reckon she didn't have any health insurance.
