Father and Daughter - British Citizenship

Hello Friends,

I am a 30-year-old man and I live in the UK with my daughter (3 years old). I have been separated (still not divorced) from my wife (Indian citizen, living in India) since over 2.5 years. I have lived in the UK for 6.5 years (5 years Tier1 and 1.5 years ILR).

My daughter is on ILR for over 12 months now.

My queries are:

1. Can I now apply for my daughter's British citizenship registration (MN1) at the same time as my naturalisation (AN) ?

2. As my wife (in India) is an Indian citizen, would that hinder my daughter's application for British Citizenship Registration under Section 1(3) ?

3. Is there a thread on this forum that attempts to list all documents (mandatory or good-to-have) needed along with an MN1 and AN application ?

1. Yes.
2. No (especially as she is UK born).
3. Check the FAQ and the last page of the application form.

Can you please reply to Question# 2 of my query considering the fact that my daughter was born in India but came to the UK as my Tier-1 dependent when she was only 4 months old. Today, she is 3 years and 2 months old, and has been on ILR for over 12 months. Look forward to your kind response.

You stated in question 2 that she applies under section 1(3). If she was born abroad, then that statement is wrong as she applies under section 3(1) and this is application at discretion. The HO would like to see that the child future lies in the UK. If the other parent is not living in the UK and doesn't have a valid visa in the UK, the HO might not be convinced that the child's future is in the UK especially if there isn't an official arrangement for the child to be under your care. It will be down to the discretion of the caseworker but answering your question - yes. The situation you described can hinder her chances.

Hi Jambo, My gratitude for your kind response. So, as I understand it, the only way left for my daughter is go the 3(1) discretion route and she will never be able to avail the 1(3) route as she was not born in the UK.
