I and my wife are planning to apply for naturalisation.
My Scenario
Arrived in UK student visa- Sep 2005
SEGS visa - Feb 2007
Hsmp and ext - Feb 2008 to Feb 2013
ILR approved- Feb 2013
My Wife's scenario
Arrived in UK on Student visa Jan 2006 (She had 5 yr student visa as she was doing PHD)
We got married in March 2008.
Hsmp dependent - April 2010
ILR approved - Feb 2013
I am sure I meet the residence requirements.
My question is will student visa count towards my wife's 5 year residency requirement? or she needs to be on residence permit for 5 yrs?
Thanks
Bhavik

Any legal visa status counts towards residence requirement for Naturalisation.
Make sure you were both physically present in the UK exactly 5 years before, to the day, that HO receives your applications.

Thanks a lot for your reply.
Another quick question if you can help
My Indian passport is expiring in 2-3 weeks time.
Can I still apply before my passport expires?
as I understand it takes atleast 6 weeks for processing.
From what i understand it is ok to do so but it would be good if i can get some advice on that.

Yes, the average is about 3 months for approval.
Are you applying using NCS or doing postal yourself?
Don't forget LIUK and English B1 test (unless you both have UK degrees)

I am applying myself.
I am submitting the following documents for both of us.
Passport
UK Driving License
LIUK test certificate
UK Msc degree certificate
ILR Biometric Card
ILR approval home office letter
Marriage certificate
I have got 2 referees one of which is a teacher and other is s/w engineer.
Thanks a lot for your answers.

Passport - covering the full 5 years and date you entered
UK Driving License - I wouldn't sent this
LIUK test certificate
UK Msc degree certificate
ILR Biometric Card
ILR approval home office letter - not really needed if supplying BRP, they have your full history
Marriage certificate - Not needed unless applying as spouse of British Citizen
I would strongly recommend using NCS as you then get to keep all your original documents and they make sure your form and docs are correct. If you used your drivers license for LIUK and is the reason you are submitting it, then even more reason I would use NCS rather than send all my identity documents by post.
There is no benefit of joint application fees any more but if you want to submit the marriage certificate, whose application are you submitting it with. Remember each person applying (even if applying together) has to meet the requirements individually.

Both or at least one of them British??

Yes i have used drivers license for my LIUK test hence submitting it.
Yes there is no benefit for joint applications on fees but wanted to submit both the applications together in next day delivery and will also put a pre-paid next day envelope with the application.
Yes both the referees are british,
I understand that NCS will check the docs and return the original docs to me but i think i have done so many visa applications on my own with the help of this website, it shouldn't be too difficult. The form is the easiest of all the applications i have done so far.
I really appreciate your help.

Good luck with your application and keep us updated on progress. Make sure you at least have a copy of your drivers license until you receive the original back.
