EEA4 application time

Hello,
I am aware that this thread is for BC but maybe someone knows answer to my question as I didn't receive any information after posting it on the EU part of the forum.
Can EEA4 application be made after 5 years wedding anniversary or does it have to be after the previous 5 years RC expire? (there is a 5 months difference between those dates, married in UK).
