British Citizenship Registration of Canadian child

Hi guys,
When my son was born in UK, my husband and I did not have settled status so he couldn't automatically become a British citizen. He is however aCanadian citizen by birth.

Even though he did not have any status in the UK when he was born here, immigration allows him to stay here until we apply for his status. Before we could, I had to travel to Canada with him for an emergency and when we returned back to UK, the officer stamped his passport with the visitor visa for Canadians (leave to remain for 6 months).

My husband and I now have settlement and are looking to apply for citizenship for our son. My son has 5 months left on his visitor's visa. Can we apply for his citizenship while he is here in the UK on a visitor's visa? If a decision on his citizenship application is not made within the next 5 months, does he have to leave the country or can he stay in the UK until the results of his application are decided?

Any help would really be appreciated!

Thanks, Zahra

His is an entitlement to register under section 1(3) of the nationality act. You can do it now on form MN1 and you should hopefully have a result within 3 to 4 months.

Hi,
Thanks for your speedy reply back! Will the fact that he is now here on a visitor's visa affect his application (mn1)? Also, will he have to leave the country if the decision is not made in time and his visitor visa runs out?
Thanks again!
Zahra

No and No, it should be fine and applications don't take months and months or years.
