Child born in UK Citizenship eligibility

Hi ,


First I worked in UK from 2005 to Jan 2008 on Work Permit .In that period my Son was born in 2007 in London. Then we returned to India for more than a year .

I came back to UK in Nov 2009 on Tier 1 visa with my Family . Our family have valid Tier 1 visa till Dec 2016 and I am eligible for ILR now after 5 consecutive years .

Do I have to apply for my Son ILR also ? I was planning to just apply for myself and my wife now. And later once we both have ILR I can directly apply for my son Citizenship in Feb 2015 . He is 7 .5 yr old .

I have read children settlement GUide MN1 and on page 10 -Children born in the UK – Section 1 (3) it clearly states that children can apply if their parents have ILR .

Please guide me if this is right .

UK-born son may skip ILR. He will be entitled to register for British citizenship directly after a parent is granted ILR.

Correct, get ILR and apply for MN1 directly.

One more final question .

Can my son travel with us in Jan 2015 on the old Tier 1 dependant visa valid till 17 dec 2016 .

I will apply for my son Citizenship in March 2015 after returning from holidays .

Our visa will be on new category - ILR
