Can i apply for British naturalisation ?‏

Dear All,

I wanted to ask one question about my wife if she can be able to apply for British naturalisation.

Here is the scenario

She came into UK in January 2012 as a dependent on me (Tier 1 General Dependent)

After spending two years with me as a dependent then she applied for ILR under old rules and get the approval of ILR in June 2014.

In June 2015, she will have one year completed for ILR and as well total duration in UK would be 3.5 years, i understand the rule is to spend atleast 5 years in united kingdom before you apply British nationality.

My question is as she came into this country when previous rules were there and there wasn't any such limit about 5 years.

Can she be able to apply British nationality after completing one year after ILR ? (total duration would be 3.5 years in UK)
Does she need to wait for her spouse to become British and once her spouse become British then can she apply for British nationality ?

Your help on this question would be greatly appreciated.

You are mistaken.

It's not a new requirement for naturalisation. It has been the case since when the 1981 Act came into force, that if you are not British, then she must complete her 5-year qualifying period.

Yes if you want to apply before five years have lapsed in UK, then only way is that you become British first.
