Hello,

I'm a naturalised BC. My (unmarried) partner is an EEA citizen (in possession of a PR document since 2012) and is currently applying for BC. We have a few questions regarding certain sections of the Form AN and I was wondering whether anyone could help:

Section 1.1 (UK Border Agency or Home Office ref number): supply the Permanent Residence number or leave blank?
Section 1.3: insert Date of Issue of PR document or the date my partner entered the uk plus 5 years?
Section 2 (residence requirements): do we need to provide documentation of residence in the uk? If so, is it for the last 5 years or to cover the period after the PR was issued? Do utility bills and/or tenancy agreements count?
Section 2.4 (EEA nationals exercising EC Treaty Rights): do we need to fill in this section at all? I should think not based on the following FAQ “Apply 1 year after the issue date of the PR Confirmation (EEA3/EEA4). In this case, there is no need to prove treaty rights again and normally just your passport (and Life in the UK test) is required” quoted on Citizens FAQs on this forum. Could someone confirm this please?
Section 6.17: is registering biometric information a requirement now? It wasn't when I applied so that took me by surprise.

Any help with these questions will be greatly appreciated.

Hi fwd079, yes, I've gone through both the AN guide and the booklet AN carefully, however, I haven't been able to find clear answers to the above questions. For example, for section 1.1 the guide says: "Enter your Immigration and Nationality Directorate or Border and Immigration Agency, UK Border Agency or Home Office reference number, if you have one." There is a number on the top right of the PR document, do I enter that? Apologies if this seems pedantic but I don't want to make any mistakes on the form.

If in doubt then leave blank, book NCS and apply, they'll enter correct one.

Sorry I am not from EU so cannot tell, shall await further replies.

1.1 Suggest add the PR # (as it is a HO-originated number);
you can cross-reference & comment in the 'further information' section if you want to fully explain what it represents

1.3 - Instructions for EEA say read pg 10/11 of guide

6.17 Yes - new requirement

About 2 - Residence:
Application notes do say this for all applicants, for "the last 5 years":
Passports or Letters from employers, educational establishments or other Government Departments indicating presence in UK;

Suggestion as PR did not apply in my case:
if I had (or could get) such letters I would probably submit them if my passport did not contain comprehensive entry/exit stamps;
&
if employers letters (etc) are not available then any other official or legal type of documents & letters would seem appropriate.

For EEA applicants, the application notes also say:
If you do not provide a document certifying permanent residence or a permanent residence card then you must provide the following for consideration: (including:) Evidence of five years continuous residence in the UK

I read that to mean by submitting a PR card you should be good.

Hi noajthan, thanks for replying. Unfortunately, the guide is ambiguous on that section but I believe entering the PR date of issue should be fine. I'll ask at the NCS.

My partner's passport does not have any entry/exit stamps (EEA); employers' letters are not available. Will tenancy agreements and council tax bills (plus the PR document) suffice?

of an EEA national, and do not have indefinite leave to remain in the United Kingdom
you should complete these sections"

I take that to mean that if you are a national of a member state of the EEA, or the family member of an EEA national, and have indefinite leave to remain (PR), you don't have to complete these sections.

In absence of employer's letters then, yes, tenancy agreements as legal documents, and council tax bills showing dealing with the authorities would support your PR doc.

For section 2 (2.4-2.6) I don't think ILR is the same as PR.
My family was not a PR applicant so I haven't done this but I think you need to fill out section 2 as you are a PR appplicant.
If you are an EEA person with ILR you would skip it.
Applying with PR I think you need to complete it.

The notes in section 6 indicate to me that PR is different from ILR.

I probably go overboard when dealing with HO paperwork but I print everything out, mark up all the relevant sections, clauses & requirements with a highlighter pen;
then work through the form crossing off each requirement as I meet it.
Finally I complete a good copy of the form based on the previous attempt.
Repeat for as long as it takes to get a rock solid application.
