what section do i need to apply under?

hi! can anyone help. im getting confused as to what section to apply for my son to become a british citizen. He was born in america in 2004 to an american mother. im his father and i am british and we live in britain. he has been here since 2007 and has indefinate leave to remain. its just all very confusing. the court has ordered he become a british citizen( much to his mothers dislike) to safeguard him but im not sure which section to apply under??

Children born abroad are Registered under section 3(1). Not sure about Section 3(2) or 3(5), this will depend on whether you are Britihs born or not. See MN1 guide for a bit of info Here (Click)

Were you married to his mother at the time of the birth or any point thereafter? You answer to this might change what you can do.

No was never married. We moved here as a couple then split. Its the sections 3(5) etc.. That's confusing as we seem to fit into all of these sections!!

If you are British by descent when child was born, then it may be Section 4F(1)(b)(iii).
