Notice of fine and collection order

Hi,

Please can anyone help me?

I am about to apply for naturalisation but I am confused about what to declare in the good character section.

In dec 2009 I was on the train and wanted to pay for a ticket using a railcard when I wasn't entitled to one and got caught. I offered to pay the full ticket but the ticket man refused.

The case got referred to city of London magistrate court. I got a letter titled ' notice of fine and collection order'. A subtitle of 'offences and penalties'.
I went to court pleaded guilty and got fined. I was given terms of payment which I met and have paid it all.

My question is do I have to declare this on my AN form? Is this a criminal offence or caution or warning?

Please Advice.

Its an offence. You are convicted by court so you have to declare it

I am sure Home Office will not find out if you don't declare it. First the fine happened not the last 3 years. Second, that will not be on the Police National Computer. Also since you paid it will not be registered on Registry of Fine Order and Judgement ( trustonline ). Lastly there is no national databases of court fine. If you check on Google You will see the various regions of Court Fine Enforcement Team, you can email them. One region cannot trace a find that happened in another region from their computers, unless Home Office will contact the whole regions that's when they can find out. Do a subject access request to Ministry of Justice.

Number of days out in the last year before Naturalisation

Hello Admin,

I will start by commending all your efforts they have really been helpful. I'm grateful.

My issue now is I have applied for Naturalisation already, but the year before my application I was out of the country for a total of 155 days all for work. I attached a letter from my employer detailing each travel and reason for travelling.

Is this enough? I have read that you should not be out for more than 90 days in the qualifying year. Is this an automatic refusal or do I still stand a chance?

I am still going to be travelling as its the nature of my job so I couldn't have waited till the number of days becomes less than 90 days.

I hope this makes sense? If not let me know so I can clarify it.

Is your employer UK-based? That may have some impact on the outcome.

However, 155 days is almost twice the allowed 90 days. Even if they were to make some allowances, I would say that the odds of a refusal are quite high. But there is always hope. Keep us posted of the outcome.

Yes my employer is UK-based so I'm hoping that helps.

ON which date you applied for naturalization ?. Please share your experience, It will be useful for many users.

Hi,

We just can think what might happen to your application and it is not us who decide so please be patient and you will see.
Anyway if you were doubtful wouldn't have been better to apply later when you are sure of the outcome? Just asking...

This is just an update to say I got my approval today!

I might have been lucky or the letter from the employer might have helped I do not know. I have just come back to update just incase anyone else is in the same situation.

@mamabibi I am in a very similiar situation as I received a notice of fine and collection order and paid my fine due to fare evasion issue. I'm applying for a working holiday visa to Aus for next year. Did you find any trouble when you declared it ? I'm still unsure whether this 'offence' will show on a criminal record check.
