Normally a person who has been resident in UK for 5 years can apply in their own right after holding ILR for 12 months (if all other requrements have been met too).

The form is AN from Gov UK website.

See form & guidance:
https://www.gov.uk/government/publicati ... en-form-an

Be aware requirements for proof of English are changing in November 2015.
You will need to check your ESOL certificate is on 'transitional list' or else on Ofqual website.

About proof of English, see:
https://www.gov.uk/english-language/overview

You may need additional advice about the period of overstay as there is now a 'good character' requirement for naturalisation which looks at issues such as overstay.
You will need advice on whether you have mitigating circumstances in your case (due to DV).

Best of luck.
