Hi guys, I'm new to this forum, but can anyone help please?
I'm uk citizens through naturalisation. My son born outside uk (the time he born I'm not yet being British)and now he live in uk over a year. So can I registered child as British even tho he not been here 2years? Or is he have to live 2years before he can register?

Thanks in advance

There is no strict residency requirement for a young child, but a minor will normally need settled status in UK for a discretionary registration under section 3(1) of BNA (as this case is).

Thank you so much for your reply, I always understood that my son have to wait as his visa is Enter leave to remain ( which is no restriction on residential)
Now I can looks into apply "register British citizens "
Thanks again :)

You need to be sure of immigration status of both parents;
parents of a child born abroad also need to have at least settled status in UK.
if not British citizens, at least one parent should be applying to naturalise (all as per the guidance).

Now..you confusing me! :(

My husband he's born British and I am live in uk 10 years and already have British passport.
My son has join my husband and I , in May 2014 , so in my case as I am already British ,
Does my son fall in categories that's " the child need to settle at least 2years especially the child age 13 and over?"" ? My son he's 11years old.
Can you clarify if my son still entitled to register or is he have to live in the uk 2 years before he's can register?
His visa is ILE

Thanks for your help

Have you read the Gov UK docs (links posted above)?

From the guidance you will see that, for a discretionary registration (as your child's will be, as child was born abroad), both parents' immigration status is significant.

If both parents are British (whether born British or naturalised as British) & are in UK then all good.
(Note this means biological parents).

As child is under 13 I don't think the 2 year guidance applies;
my understanding is that's more for older children (late teenagers).

So if both natural parents are settled in UK and child's ILE means 'free from immigration restrictions' then you are good to go ahead with registration.
