Child Born in UK, Citizenship Application Timeline

Hello people,

I have read on this forum that for a child born in the UK, once either of the parent gets an ILR, the child automatically becomes eligible for British citizenship.

In my case, my wife & I plan to apply for our ILR in Jan '16 once we complete our 5 years and will omit our child's name from the application form for ILR as we intend to file for his citizenship.

Please correct if the understanding is incorrect.

Now, the question is, our son is on a Tier 1 Dependant Visa which expires in Feb '16. Do we need to apply for his British citizenship prior to his current visa expiry OR can we apply anytime after his visa expiry as long as he doesnt have a plan to travel outside the UK?

P.S: Since he was born in the UK, we didnt apply for his Visa until he travelled for the 1st time outside UK for a short vacation. We got his current visa stamped prior to returning to the UK.

No, he does not need valid leave to remain to apply for citizenship as he is entitled to apply. Only problem will be is if you need to travel and he does not have a valid visa.
