Residence requirement for Naturalisation(5 Year Route)

Hello,

I first entered UK as dependent partner in Nov 2010.

I was then a PBS dependent. I applied for indefinite leave to remain at the same time as my husband and I was granted ILR in July 2014.

Now I have completed 5 years of legal residence in UK and its more than a year I was granted indefinite leave to remain.

My husband and myself currently hold Indian passport.

I am about to apply for naturalisation in Dec 2015 taking the 5 year residence route but please can anyone confirm if I can apply now ? or should I wait for 5 +1 =6 years ( 5 year residence + 1 year, after ILR period) to meet the residence requirement for naturalisation?

You can apply now as you have held ILR for 1 year and have been resident for 5 years.

You also need to have been physically in the UK on the same day five years ago on the date of the application.

So, were you to apply today, you had to physically be in the UK on 28th November 2010.

If this condition is not met, the application must be refused (the Home Office has no discretion on this rule). But they will keep the fees.
