Hi there
I am a bit confused what to do next! I recently received my PR but i am not sure if i can apply for British citizenship in a year... My first contact with HO was in 2009 and i heard about the 10years rule last week.. Prior to that i was illegally in the UK for 5 years.
Can someone tell me if i have to wait till 2019 or i can apply in a year time??
Thanks
Pablo

Thanks for your prompt reply.
Will it start from the date of acknowledging my coa? Or the date on my RC?
Thanks

When did your
illegal stay commence
9.5 Illegal Entry
In circumstances where an applicant entered the UK illegally, an application for citizenship should normally be refused for a period of 10 years from the date of entry, if it is known.
If it is not known, the period of 10 years starts from the date on which the person first brought themselves to or came to the attention of the Home Office
Ref HO guidance on this vital matter:

Thanks. I came to UK in 03 January 2004. Why does it matter ? Would they believe me if i put it in the application?

HO won't believe you without supporting evidence.
It matters because any ban will run from entry or from when HO became aware of it - whichever is later.

HO will also be very interested to know what you did in the UK for 5 years without any legal status (i.e. did you work and with what proof of residence and right to work)?

Well i entered illegally back in 2004 and never made any contact with HO until 2009 when i applied for COA to get married. So technically from what i understand from you is 2009 the 10 years start???

Unless it starts in 2011 as you mentioned illegal for (past) 5 years.
So either from 2009 or 2011 based on your outline plus the HO guidance.

So likely you paid no tax on your earnings then??
You do realise that you have to declare your employment on the form (as the rules stand now)
