HMRC penalty after tax inquiry

Hi,

I made a mistake in filling tax returns for the year 2012-2013 and didn't declare a new full time job on self assessment form as thought that was only for company related income. There was another minor goof up but I accepted the penalty for year 2012-2013 tax return and paid immediately. Will this be seen as tax evasion and going to lead to a refusal for British citizenship?

As you have accepted this and paid it, this will not lead to a refusal.

From your posts, it seems like you was on Tier 1, if you claimed this income while your extension but didn't declare this to HMRC then this is a different story and HO is treating this very strictly.

OK Thank you. I was on ILR when the inquiry started. I will declare it in summary on the form. I hope that is sufficient.

I would strongly suggest not to declare this. You are not required to declare this.

please list all of your jobs in employment history including self-employment and it finishes there.

Also, if the PAYEE job wasn't declared in self-assessment then it may not be a big issue as you did pay tax for the job.

I have re-read your response. I was on Tier 1 Extension in 2013, got ILR in Nov 2014. We only found out about this when inquiry started in Jan 2015. It was unintentional and I was unaware of any wrong doing. I declared all incomes in the renewal application. It was a mistake in filling self assessment form. HMRC had details of my company and full time employment. I had provided HMRC's 5 year history in my ILR application. Everything was accounted for apart from not declaring this in self assessment form and account calculating wrong tax bracket for the other income due to this.

Don't worry about it. You have done nothing wrong so you should be fine.

Just don't complicate this by providing the unnecessary information (like tax history) to the case worker.

OK Thanks again. It felt like a big deal so I wasn't sure if I should disclose it or not. I will not mention it on the form. Thank you.

Sorry to open the thread again, would it not come under a civil penalty? Or just having the books clear with HMRC is sufficient?

Hi, This isn't a civil penalty. As long as your books are clear, you are good.
