EEU PR card, IRL, Criminal checks. Draw the distinction pls?

Hello forum members !

Two distinctive questions:

1) Is the criminal record check somewhat more extensive when the HO consider application of Permanent Residence and when it considers for the Naturalisation ? In both applications the HO carry out criminal record checks, but the question is it more "deeper" for the Naturalisation application or generally the same?

2) Residency requirement for EU citizen with PR card when applying for the British Citizenship! As an EU national, the fact that the applicant provides his/her PR card is enough or he/she need to still provide docs of 5 years continuous residence as in the case for IRL non eu national as I understand non-eu nationals with IRL still have to prove 5 year residency.

It made me wonder, why there is a need of PR if it already proves that the person has been residing lawfully in the UK for 5 years, still need to provide residency docs when submitting AN ?

1. HO checks more in depth for citizenship applications and ALL applicants over the age of 10 have to meet the stringent 'good character' requirement.

2. PR card should be sufficient. You have misunderstood about non-eu citizens. Our passports have been stamped entering and exiting the UK, that is proof of residence for us, there is no reems of documents we have to submit.

as regards to question 2: oh I never knew that for non-eu it is much easier to check their residency because of the stamps during the travelling! But for eu citizens passports are obviously not stamped. But I guess PR proves the residency requirement ? I suppose so. Any opinions, does anyone experienced that he/she is asked to provide additional residency docs along with their PR card when applying?

The PR card/document only proves your residency for the qualifying period in which you earned PR. If this was the most recent 5 years then it's not a problem, if it was a 5 year period some time ago you will need to submit additional documents to prove you are still resident.

My 5 year PR qualifying period was 2007-2012 and I applied for naturalisation in 2016, so I had to prove I was still resent between 2012 and 2016. I did this by simply including P60's for those years.

Ohara - thank you. You pretty much answered my question. My PR qualifying period is from 2009-2014. I will apply for the naturalisation soon and therefore I will need to provide documents proving that i have been a resident in the UK from 2014 up until I submit my application. I will submit my P60, Bank statements. Hope that will suffice.

Yep, you've nailed it. Providing HO has correctly recorded your date of PR in 2014, you can apply for naturalisation immediately upon receiving the PR document.

If you use NCS to send your application, they will check the date of your PR with the Home Office to make sure it is correct.

There's no need to submit bank statements; P60's alone will suffice.

Ohara - have you already applied for the naturalisation? and if so what docs did you send, was the application successful?

Yes I applied in March and it was approved in June.

Documents I sent:

AN form (obviously)
2x Finnish passports
Document certifying permanent residence
Life in the UK pass certificate
Trinity College B1 English certificate
P60's for years 2012-2015 + 1 payslip from Febraury 2016
Short covering letter explaining some stuff like my signature being different between passports and not knowing my date of first entry to the UK

Congrats Ohara ! Oh well i do not remember what i mentioned for my PR application re my date of first entry to the uk. what if i give a different date of that i gave for my PR??

Ohara -

My friend had an interview before she received the passport. Interview by that I mean british citizenship interview.

I do not remember what date did I put in the application when I applied for my PR. Now soon I will need to mention my date of arrival in the UK again and I know it was june but I do not remember the exact date.

You won't have an interview for naturalisation unless your case is complex and HO need to ask you questions. It's pretty rare and I have only seen a couple of cases on this forum where it has happened, and usually to people who have shady immigration history.

You will however have to attend an interview to confirm your identity if you apply for a British passport. This is mandatory for all first time British adult passports now. The only exception is if you use the NCS JCAP service, then you will not have to attend an interview.

ohara - Yes apologies, thats what i meant actually, the interview when you apply for the passport.

Did you have it? and if so, what kind of questions you were asked?

If you apply for the passport as a separate application after citizenship approval and ceremony, you will be required to attend an interview at HMPO before they issue you with a British passport. It is only applicants who apply using the JCAP (joint citizenship and passport) process that don't seem to attend a passport interview.

Everyone (not on JCAP) has an interview. Its to help HMPO crosscheck and verify the applicant and their identity.

The interview for the passport is to verify your identity, so ideally not something you should have to prepare for. It is more like a face to face chat so that the HMPO can be confident that you are who you say you are and they verify what you tell them with what you said on your forms.

So long as you know yourself, you should be fine.
