British Citizens Spouse path to Citizenship via Appendix FM

Hi All,

This is my understanding for a spouse of a British Citizen coming into the UK via Appendix FM 5 year route.

Initial Spouse Visa (33 Months Visa) > Further Leave to Remain (FLR M Extension of 30 Months) > Apply for ILR (Indefinite Leave to Remain) after completing 5 years > Spouse now can apply for British Citizenship as after ILR granted there are no restriction placed on the spouse for residing in the UK therefore spouse now is free to apply for British Citizenship immediately after getting you ILR Status

The reason why I am posting this is that I am a bit confused as I have read on solicitors website that the spouse would need to spent 12 months on the ILR prior to applying for British Citizenship.

Under the current legislation a British citizen’s spouse can apply for British Citizenship after 3 years in the UK as long as there are no immigration restrictions so I really can’t understand why a spouse who has gone through the 5 year route requires to stay another 1 year on ILR.

Forum members opinions and understanding would be much appreciated.

It's understandable why you are confused. There is no such requirement to stay another 1 year on ILR for the spouse or civil partner of a British citizen.
